OFFICIAL RULES

NO PURCHASE NECESSARY. CONTEST BEGINS AT 12:00:00AM ET ON 5/1/09 & ENDS AT 11:59:59 PM ET ON 7/1/09. ALL ENTRIES MUST BE RECEIVED BY 7/8/09.

  1. HOW TO ENTER: Complete official entry form (an "Online Entry") available at www.PedigreeKmartContest.com ("Contest Site"), including an essay of 500 words or less describing why your dog deserves a one-year supply of PEDIGREE® Brand products (the "Essay"). To enter by mail or to request a copy of these Official Rules, print your name, address and telephone number, and age on a 3"x5" piece of paper ("Mail-In Entry") and send it together with your Essay to: PEDIGREE® Brand Essay Contest, PO Box 9242, Medford, NY 11763-9242. (Please enclose a self-addressed, stamped envelope with requests for Official Rules.) MAIL-IN ENTRIES MUST BE POSTMARKED BY 7/1/09 AND RECEIVED BY 7/8/09. ON-LINE ENTRIES MUST BE RECEIVED BY 11:59:59 PM ET ON 7/1/09. No illegible, incomplete, forged or altered entries will be accepted. Limit: one entry per person and dog. Entrant must be legal owner of the dog described in the Essay. If additional entries are received per person and dog, then only the entry received earliest will be judged. All entries, including Essays, become the exclusive property of Sponsor and will not be returned. Essays (i) may not have been previously published or won any other prize/award, (ii) must be the exclusive original work of the entrant, true and verifiable, (iii) must be in keeping with the Sponsor's image, (iv) may not be inappropriate, offensive, libelous or defamatory, pornographic, sexually explicit, unlawful or plagiarized, as determined by Sponsor in its sole discretion, (v) must not be harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way, as determined by Sponsor in its sole discretion, (vi) may not violate or encourage others to violate any applicable law, statute, ordinance or regulation, (vii) may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party right, (vii) may not contain commercial/corporate advertising, including but not limited to corporate logos, brand names and slogans, other than those relating to the PEDIGREE® Brand, and (ix) may not include any virus, worm, corrupt file, Trojan horse or other forms of corruptive code or content that may harm or compromise the Contest Site and/or the proper conduct of the Contest. By submitting entry (including Essay), entrant represents that: (a) he/she has the unrestricted right to submit the Essay and (b) the Essay does not infringe upon any third party's proprietary or other right. By entering, each entrant unconditionally and irrevocably assigns and transfers to Sponsor any and all rights that he/she now has or may in the future have in and to the Essay, including, without limitation, the copyrights, in any medium whatsoever. Sponsor will have the unrestricted perpetual right to use, not use, alter, edit, publish, display and/or transfer each Essay however it sees fit without further approval of or payment to entrants. Sponsor may feature selected Essays ("Selected Essays") on the Contest Site from time to time in Sponsor's sole discretion. Selection as Selected Essay is not a part of this Contest and does not imply selection as a prize winner.
  2. SELECTION OF WINNERS: Winners will be selected on or about 8/7/09 from all eligible entries received on the basis of creativity (75%) and adherence to theme (25%) by an independent judging organization, whose decisions are final on all matters relating to this Contest. Winners will be notified by overnight delivery.
  3. PRIZES: Ten (10) Prizes: 12 20lb bags of PEDIGREE® Brand Dog Food (Approximate Retail Value ("ARV): $12.99 per bag); 120 13oz cans of PEDIGREE® Brand Dog Food (ARV: $0.75 per can); and 12 5oz bags of PEDIGREE® Brand Good Bites Treats (ARV: $3.29 per bag). ARV of each Grand Prize: $285.36. Total ARV of all Grand Prizes: $2,853.60. All prizes will be awarded (assuming sufficient number of entries). Limit: one prize per family or household. Sponsor reserves right to substitute prizes of equal or greater value. No other substitution or transfer of prizes permitted. Sponsor responsible only for prize delivery; not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of winners.
  4. ELIGIBILITY: Contest open to individual legal residents of the 50 United States and D.C., age 18 or older as of 5/1/09, except employees (and their immediate families and members of the same household) of Sponsor and its affiliates, agents, judges and advertising and promotion agencies.
  5. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES: Winners may be required to sign affidavits of eligibility and liability releases and, where permitted, publicity releases. Prize may be forfeited if affidavit is not returned within 14 days after mailing to winner or if prize notification letter or prize is returned as undeliverable. If any prize is won by a minor, it may be awarded in the name of a parent or legal guardian in Sponsor's sole discretion. Winners agree to use of name, address, likeness and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law, any such use with respect to minors to be subject to prior approval of parent or legal guardian.
  6. GENERAL: This Contest is void outside the United States and where prohibited or restricted by law and subject to all applicable federal, state and local laws and regulations. This Contest will be governed by the internal laws of the State of Delaware. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the United States of America. Sponsor and judges are not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, incorrect or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Sponsor and judges are not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Contest, and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor's control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted and the winners will be selected from among all eligible entries received prior to such time. Sponsor reserves the right, in its sole discretion, to disqualify any entrant from this Contest or any other promotion conducted now or in the future by Sponsor or any of its affiliates if his/her fraud or misconduct affects the integrity of the Contest. By participating in this Contest, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges and warrants that he/she is eligible to participate in this Contest. By accepting prize, winner agrees to release Sponsor and its directors, employees, officers, and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prize or participation in any prize-related activity. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
